Guardianships
Guardianships are designed to protect the welfare and rights of individuals who cannot handle their own affairs. Florida law requires the Courts to appoint a guardian for minors in circumstances where a minor's parents die or become incapacitated, or if a child receives an inheritance, legal settlement or insurance policy proceeds exceeding the amount allowed by statute. Guardians are also needed in cases involving incapacitated adults or the elderly who are estranged from family or have no next of kin. The guardian acts for the benefit of the individual and/or to secure assets, until such time as the individual has capacity or for the individual's lifetime.
