Hi, my name is Denise Jomarron, and I'm an attorney in Miami specializing in Probate, Guardianship, and Estate Planning. Probate is the process in which the court oversees how your assets are distributed to your heirs at law if you pass without a will, or to your intended beneficiaries named in your last will and testament.
One of the most common questions we get asked is how long will the probate process take. The timeline of a probate can vary from case to case, but generally, a summary administration will take anywhere from 2 to 4 months, sometimes longer. The formal administration, which is the longer process, can generally take anywhere from four months to a year, and even that can be extended a little longer.
Several factors can influence the timeline of a probate case. If there are multiple beneficiaries and disagreements among them, this will definitely cause delays. Another delay may be caused when the proposed personal representative does not have all the contact information for all the beneficiaries of the estate. Another delay that we often see is the processing of court orders with financial institutions that must turn over the assets into the probate restricted account.
